Types of bans

There are two types of bans, Congressional band and Delegate bans

Delegate bans

The delegate has the right to ban any nation. If he oversteps his power he can be impeached. He cannot ban a congressman without congressional approval. Neither congress or the supreme court can interfere.

Congressional bans

Congress may ban anyone they want with a 3/4ths vote. They cannot ban a member of the delegates cabinet without delegate approval. The delegate must abide by the congressional ban. The supreme court cannot interfere.

The Supreme Courts role

A nation can appeal their ban directly to the supreme court. The SC can overturn the ban with a unanimous vote.

Reverse Grandfather Clause

Any nations banned by the delegate or the congress before the overhaul are still banned. The VD is tasked with updating this list.

You will all start yelling for me posting but I object to the Supreme Court portion. The job of the SC is to keep the other powers in check. This law inhibits its core duty.

How so? They are keeping the other powers in check. They just can't repeal bans.

"They will oversee the actions of the other two branches and ensure their actions are lawful. "

If either branch unlawful bans a nation by violating their Rights (see Rights of Member Nations) it is the duty of the Supreme Court to overturn the ban. Additionally the Supreme Court is already granted the power to overturn bans if the banned nation appeals.

Constitutional law supersedes Congressional law.

Im going to agree with RWA, Supreme Court should be able to repeal bans if they are unconstitutional

Bans can't be unconstitutional. Nothing in the constitution limits banning power.

While RWA is correct that Constitutional law supersedes Statutory Law, I'm going to vote Aye. If the Court wants to overturn it so be it.

Can we pass this so I can ban Ing

Alright. SC can only overrule a ban with a unanimous 3 Judge ruling, rather then the regular 2. Better?

Yes. Maybe I wasn't clear before but that is what I had intended. I hadn't wanted the Supreme Court to review every ban case automatically.
